Phoenix Technologies, which develops PC BIOS and related software, reported today that it has sued startup
DeviceVM and a former Phoenix employee, claiming trade secret theft. DeviceVM makes Splashtop, software which makes the PC bootup process faster through an "instant" boot process. Phoenix said it is seeking restitution, compensatory and punitive damages, as well as a constructive trust. DeviceVM is venture backed by New Enterprise Associates, Storm Ventures, DFJ Dragon, as well as Tim Draper and Larry Augustin.
