Alviso-based digital video recorder firm Tivo has seen a further setback in the firm's battle with DISH Network and Echostar today, as the U.S. Patent and Trademark Office rejected software claims made by Tivo in one of its patents. According to Tivo, it was "disappointed" by the PTO office action, but said the patent claims rejection was "separate and apart" from its litigation against Echostar. For its part, DISH Network and Echostar said the ruling are the "same claims" EchoStar was found to have infringed upon, claims that EchoStar said patent examiners says are "unpatentable" due to prior art.
